Terms and Conditions for Hope23Book App

These terms and conditions (“Agreement”) govern your use of the “Hope23Book” mobile application (“Mobile Application” or “Service”) and any of its related products and services (collectively, “Services”). This Agreement is legally binding between you (“User”, “you” or “your”) and Hope23Book (“Hope23Book”, “we”, “us” or “our”). If you are entering into this Agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such an entity to this Agreement, in which case the terms “User”, “you” or “your” shall refer to such entity. If you do not have such authority, or if you do not agree with the terms of this Agreement, you must not accept this Agreement and may not access and use the Mobile Application and Services. By accessing and using the Mobile Application and Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. You acknowledge that this Agreement is a contract between you and Hope23Book, even though it is electronic and is not physically signed by you, and it governs your use of the Mobile Application and Services. By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use the App.

 

  1. Acceptance of Terms:

By downloading, accessing, or using the App, you agree to these Terms and any additional terms incorporated by reference. These Terms constitute a legally binding agreement between you and the Company.

The Company grants you a personal, non-exclusive, non-transferable, limited license to download, install, and use the App solely for your personal, non-commercial purposes. You may not modify, distribute, sell, or create derivative works based on the App.

By submitting content to the App, you grant the Company a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform such content in connection with the operation of the App.

   Your use of the App is subject to the Company’s Privacy Policy, which governs the collection, use, and disclosure of your personal information. By using the App, you consent to the collection and use of your information in accordance with the Privacy Policy.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS.

 

  1. Limitation of Liability:

   IN NO EVENT SHALL THE COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.

    These Terms shall be governed by and construed in accordance with the laws , without regard to its conflict of law principles.
